Money laundering scheme issues
MozzartBet has returned to court to fight the Kenyan State. According to Business Daily, the company says that the millions are meant to buy software that’s meant to upgrade the betting firm.
Justice Esther Maina ruled in April that the money was held in three bank accounts as part of an alleged money-laundering scheme supported by payments through M-Pesa. Justice Esther Maina declared that the money had to be forfeited to the government, as a result.
The petition was filed by the Assets Recovery Agency (ARA) which stated that the funds were not earned through gambling under the MozzartBet, a company that is a business which is currently under greater scrutiny from the State.
The agency states that the unclear source and transfer of the money to various accounts, which include some that are belonging to MozzartBet as well as to numerous companies related to directors and shareholders of the company, suggest a money laundering scheme.
MozzartBet is now appealing to the court as a counterattack to the petition.
“Should its appeal succeed, the interested party (MozzartBet) will face serious, potentially insurmountable, hurdles recovering them, given, what is a matter of public notoriety, the process of recovering judgments against the government and its agencies,” the company wrote in an application.
“As a first instance court, which is not infallible and given that the interested party has a right to appeal, this court has got both the jurisdiction and in an appropriate case, a duty to preserve the subject matter of such an appeal by granting such interim relief as may be appropriate,” it said.
In the present, MozzartBet is appealing and has requested a suspension of forfeiture, in the meantime of the decision in the appeal.
The ARA dismissed mozzartbet’s explanation that it had paid to purchase through Kimaco Connections a software, that it subcontracted to another company called Open Skies Management Services –to provide.
Peter Kiilu, the owner of Kimaco Connections, allegedly wired Sh242 million to Open Skies Management Services, which is owned by Zimbabwean Emmanuel Charumbira and a shareholder of Mozzartbet.
The agency states in documents filed in the court that usage for mobile services to transfer money through MozzartBet or Kimaco Connections was adopted to avoid or circumvent the reporting limit as well as Central Bank of Kenya guidelines requiring holders to disclose the source of the funds.
The ARA said to this court that the monies were later distributed to a variety of companies that are directors or shareholders of the betting company.
